I would like to say that this site has been extreemly informative as I am currently facing criminal charges and I am innocent. It has been 2 years that this case has ruled my life. I have been assaulted during a raid by a police officer and will never prosecute it as I feel it would jepordize my current case. I have spent over $30,000 and I am on my fourth lawyer. As soon as I felt they were incompetent, I fired them. I am in a position now, that the crown wants me to plead to a charge that has a minimum of 1 year in prison - they have no other charges to think of charging me with as they have very little evidence and the only eveidence they have only points to one charge. I am sick an tired of the justice system ruining people's lives. After so much money wasted, so much time wasted, and the fact that I lost my career, I would plead to something that I innocent of. I know that sounds crazy....but I know many other people that have done the same. So I am sure the number of people that are innocent and sitting in jail are far greater than we think. I encourage you all to investigate cases where Police actions are unlawful. I can guarantee that almost every raid includes assault and theft on behalf of the police officers. I know they did in my case and I am sure they did in others.
 

Visitors to this site may be very interested in the case of Eliza Jane Scovill, well documented at JusticeForEJ.com. The LA coroner says she died of AIDS-related pneumonia, even though there were no overt symptoms. Another pathologist/toxicologist has blamed an allergic reaction to the antibiotic amoxicillin. The parents hold unconventional views on HIV and AIDS, the father has produced a critical video (well before this death) and the mother has written the book "What if everything you thought you knew about AIDS was wrong" (she has been HIV positive, indeterminate and negative on various tests since 1992). Is it payback time for their heretical views?
 

This comment is directed toward the Larry Fairchild/Elizabeth Krusinga case. I have known Larry since roughly 1999 and have thought we were good friends, yet he never told me about this case. He referred to this woman as the Indiana woman and when telling the story told me how abusive she really was. Its nice he is sticking up for her but after shooting someone three times and then going back down to the bedroom with the guy that she was in bed with and leaving Larry to bleed out I find it hard to believe this was an accident. I believe she did this and had something to do with all those other deaths. I believe Larry truly loves her and would like her to be innocent. But telling the truth to everyone in this case would definitely have been a stronger case. I now feel like after all these years of being lied to ( I have set him up on dates with other women folks) that I was never truly his freind and that the whole "freindship" was a lie. I felt very shocked and hurt he lied like this. I think she is sitting right where she should stay. I am glad you have this website for those tha tare injustly accused tho. They have a right to fight their cases.
 

I see that Michael has been sent to the Taylorville Correctional Center, about 250 miles away. Did they try to send him as far away as possible to make it as difficult as possible for friends and family to visit?

I hope he is doing as well as possible. I am sure it is a scary place. I hope he is being treated well and has not been harrassed or worse.

Most of all I hope his appeal is successful and he gets out of there SOON!!!
 

I see postings have been few of late. I hope people are still concerned about Michael and overturning this terrible miscarriage of justice.

Can someone from the family or friends give us an update -- how is the appeal coming? Has a hearing date been set before the appellate court?

How is Michael himself holding up? Is he being treated as well as possible at Taylorville? Is he in the general population, or does he need to be in protective custody? Has he been kept safe from harm there?

Please let us know. We are all concerned.

Cardamone is a terrible creature, not worthy of being called a fellow human being...There are more girl that this happened to than he was even prosecuted for, and they are still dealing with the trauma inflicted on them by this monster...I hope he gets the treatment he deserves in prison, especially from his fellow inmates(I know they don't like child molesters, and that comforts me)..I hope that in his 35 yrs in prison that not one day is he able to sit down without discomfort and I hope visions of the girls haunt him till the day he dies...to those who support him, you should be ashamed of yourselves and should stop being so naive...may he rot in hell for all eternity

As much as you wish, Michael will not spend 35 years in prison in even the worst case scenario.

Hopefully, he will be out soon when his appeal overturns his unjust conviction which you viciously orchestrated out of lies.

You are the naive one if you expect intelligent, honest people to believe any of the preposterous story that you and the minions of the evil Mr. Birkett cooked up.

unfortunately you are correct about the 35 years, not that he doesnt deserve that or more...

I have no relatives and/or friends that took part in this trial, and surely you have a biased opinion, but this sick individual was convicted of heinous acts against children, and for that there is no forgiveness from any God

I feel for his family. They are victims in this case as well because thier father/husband has/had a problem, and now he has to pay for what he did...It is unfortuante when individuals ruin their own lives and the ives of their families, especially for something as sick as what occured in this case

Given, that, don't be so quick to assume your "credentials and character" are better than mine or anyone else's who disagrees with you about this case. BTW, what do you mean by "credentials" anyway?

Yes, I am biased. While I believe Michael is innocent, I think there was enough "reasonable doubt" in this case to render the jury verdict totally irrational.

BTW, you are biased, also. Heavily the other way.

However, no one receives a fair trial in DuPage County. Judge Burke, like almost all of the judges in the 18th circuit, came to the bench straight from the prosecutor's office and his rulings showed great bias in favor of the prosecutors and could well be the basis for Michael's appeal being successful and awarding him a new trial - this time, hopefully, a fair one in a venue away from DuPage county.

Ever since the Nicarico case, many people are very cynical about the candor and truthfulness in the DuPage County State's Attorney's Office. The DuPage prosecutors,in general, have shown that they do not care about innocence or guilt, just their conviction rate, regardless of truth, facts or evidence to the contrary. After all, Birkett, Jim Ryan before him, and their assistants have shown that they would condemn to death a person whom they knew was innocent, in order to save face and preserve their conviction rate, rather than be honest and admit they had made a horrible mistake. They will have to live with that forever. That's why people are so skeptical of the prosecutor's motive and actions in this case. And that's why we neither believe nor agree with you, their latest pawns.

Your moralistic statement that those who argue for Michael's innocence "should be ashamed of themselves" is just as hollow and repugnant as Vice President Cheney's statements that those who disagree with the pursuit of the war in Iraq are unpatriotic.

Did you ever stop and think about why you and the other parents of the accusers have had to work so hard to try and convince people outside your own little vicious circle of Michael's guilt?

If this case was the "slam dunk" that you are trying to convince us it is, you wouldn't feel the need to have to constantly try to justify your behavior and your opinion.

I am not ashamed that I believe there was enough reasonable doubt in this case to justify a verdict of not guilt. And I am definitely not ashamed to believe that Michael is innocent.

And Zellner doesn't take cases she doesn't believe she has a good chance of winning.
 

i hope michael is enjoying his stay and prison and heres to hoping he spends many more years thinking about the horrors that he has caused for the children he so greedily stole innocence from and how he has ruined his own family and now they have to live with his actions...hope the sick bastard gets a nice present from a fellow inmate for chirstmas...
 

There is justice in the world. Michael's conviction was overturned today by the 2nd District Illinois Court of Appeal. The 2nd District Illinois Appellate Court ordered a new trial for Cardamone. In its 70-page decision, the three-judge panel cited several trial errors, including faulty instructions given to the jury by DuPage County Judge Michael Burke, exclusion of certain expert testimony sought by the defense and improper referencing of crimes with which Cardamone was not charged
 

All along I knew this story was odd. It just never made sense that NO ONE from the gym was ever questioned by authorities, the jury never got to see the facility and the girls quit going to couseling because it was boring and inconvienent to their schedule.
I pray for the family that Michael gets to hold is sons very soon. It has been a long time that he has deserved to be free. Unfortunately, his life will never be the same because of these lies.
Also, did I read correctly that not only was the case completely turned over, but was published? As in published as a referral case for future unjust crimes with no evidence or wittnesses. That says quite a bit about the case from the Appeals Court if this is true.
 

It should be rather obvious to any adult that this was a sham trial from the beginning.The Judge selected,the convict at all cost county prosecutor,along with the crime Mr. Cardamone was charged all added up to a conviction based on all of the heartstrings that it tugged on! Come on, the crime one is charged with in no way influences guilt, people.
 

What happened to all the supporters from the gym and area? Seems like a lot disappeared. Did he really file for divorce? WOW! Now something is really weird.
 

Now Birkett is piling on perjury charges based on Michael's testimony in the witness harrassment case. This is an obvious attempt to squeeze Michael for a plea deal, and malicious prosecution at its worst. They got the judge to delay the bond hearing until January 2nd, probably to insure that Michael can't spend Christmas with his family. What a crock. Michael needs to get a change of venue here, quick. He cannot be treated fairly in Du Page County. He also needs to get a new lawyer. I noticed Laraia represented him at the hearing. He is clearly not up to the task and is in no way talented enough to get Michael acquitted. Michael needs to either have Zellner and Johnson handle this case, or he's got to get Thomas Breen. They are the only ones that can get him acquitted and out from under this horrible miscarriage of justice.
 

Another reason Birkett may be piling on the perjury charges here is that he is afraid that Michael has a good chance of being acquitted in the retrial. Especially if he gets a fair trial. . . somewhere else than Du Page.
 

Or, it could be they added the perjury charges because he is a lying, convicted felon. I'm sure he is divorcing his wife because she is telling the "truth" and will no longer protect his guilt. Didn't I hear the ring leader, LL, may have gotten in a little trouble with the authorities? Sounds like the apple doesn't fall too far from the tree.
 

Why did Michael file for divorce? Why is Alysha caring for Michael's two sons? Why aren't they with Elizabeth? Why did prosecutors promise help to Elizabeth if she talked to them and told them that Michael committed perjury in the harrassment case? What kind of trouble with the authorities for LL are you alluding to? Is there a rift in the family between Elizabeth and her mother-in-law and her sister-in-law? Why did Michael really file for divorce?

I see that Linday Lynch was charged with supposedly altering gym records before the 2005 trial. It sounds like Birkett is just trying to put the squeeze on the whole family because he knows Michael has a good chance of being acquitted on the retrial of the sexual molestation charges. Just shows what shitbirds Birkett and his assistant prosecutors are. That whole office and all of the Du Page County law enforcement, including the 19th circuit court judges, stinks to high heaven. The whole place is a cesspool of corruption. Far worse than Cook County, because it's smaller and fewer people are watching. And Birkett wants a statewide office. God, I hope the people have enough sense not to elect him to anything. He is just purely evil, and will stop at nothing to get what he wants. He will ruin people's lives with impunity. I hope that some of the same things happen to him and his family that happened to Jim Ryan and his family - as payment for their evil deeds. Ryan and Birkett and McGimpsey and Pawl - the prosecutors in the Cardamone case - all lower than pond scum. And the girls and their parents are right in there with them.

The cardamone/lynch clan might want ot remember one thing, If you don't want to be charged with a crime then don't commit one.

To clarify - I said LOWER THAN pond scum. And yes, I meant all of them - Birkett, McGimpsey, Pawl, Judge Burke, the parents, the girls - all of them. And all of Du Page County law enforcement - a cesspool of corruption.

Funny how perjury and forgery was never thought of by Brickhead's office until the conviction was overturned, and they couldn't run the new trial with all the bullshit they slung in the first trial, and if it was a fair trial, Michael might get acquitted.

These continuing new charges are just a naked squeeze play on the family to get Michael to plead. It is an appalling abuse of power by the State's Attorney's office. Sometimes those things have a propensity to turn around and bite you in the butt. Birkett should be wary of that. He should think about what happened to Jim Ryan and his family after Ryan's evil deeds in the Nicarico case. Good people don't like to see innocent people being railroaded into a conviction - especially sending a man you know is innocent to death row.

Birkett and his prosecutors have the morals of an alley cat. They don't give a shit about guilt or innocence. They just want to notch their belt with that conviction.

And for the record - I do not live in Du Page county, and I am not a friend or relative, nor do I know anyone in the Cardamone family. I am just a person who follows these cases and sees all of the law enforcement misconduct going on here.

I think we should all ban against prosecutors who spent their days trying to put away criminals who rape and murder and abuse our children.
 

I have nothing against honest prosecutors who act professionally and care about the truth, and who convict the guilty and acquit the innocent.

Unfortunately, absolutely no one in Birkett's office meets that criteria.

And apparently some people who post here don't know the difference between honest prosecutors and Joe Brickhead's office either.
 

Well..havn't been here in a while and sorry for not posting a update on Elizabeth.
Yes...the wonderfull state of Michigan FINDLY gave Elizabeth a parole on 04-10-o8...to Battle Creek Michigan...where the local parole office has made her life a living hell ever sence. They won't let her live with her husband ( ME )...they force her to live in a Adult Foster Care home...say she is STATE OWNED till May of 2010 when her parole will be up. They have thrown her in jail 3 times so far sench she has been out, the last time was a total of 6 weeks for leaving a A.F.C.home without permison of the GODS AT THE PAROLE OFFICE...this place was nasty, had 3 dogs that barked non-stop and shead all over...another woman living there stealing everything she could...and Elizabeth was suppose to live like this?? And she can't live at home with her husban???..Ohhhhhh...THIS IS SOOOOO MUCH BETTER....
 

Does anyone have an update here? Are they getting a divorce? Is he guilty? Why are the two boys not with her? Is there going to be a new trial?
